Nota Bantahan ini disampaikan kepada Y.A.B Dato Seri Abdullah Bin Haji Ahmad Badawi dan juga dihantarserah kepada Y.A.B Dato Seri Mahathir Mohamad, Dato Seri S. Samy Vellu, Dato Dr. Rais Yatim Ketua Pembangkang Malaysia, Peguam Negara Malaysia, Presiden Majilis Peguam Malayisa, Presiden Parti-Parti PAS, DAP, PKN, PRM dan kesemua ahli-ahli Parlimen Pembangkang, Hakam dan Suaram.

Introduction

According to the family the deceased was arrested on 3.04.2002 was moved to four different police stations, become critically ill at the Putrajaya Police Lock-up and only then was he sent to the Putrajaya Hospital where he died. The deceased does not have a criminal record and was an innocent healthy 19 year old teenager who was on his way to a shop to buy some things when he was arrested.

Laporan-Laporan Polis

1. Laporan Polis NO.1181/02 bertarikh 21.06.2002 oleh Si Mati terhadap pihak polis mengenai kematian adiknya dalam tahanan polis.

2. Laporan Polis abang Si Mati S. ASOKAN No. Putrajaya/001198/02 menyatakan yang pihak polis dan Hospital Putrajaya yang tidak membenarkan mayat diambil.

Serial Arrest

We wish to record and register our protest at the Serial Arrest of the Royal Malaysian Police Force as follows:-

1. First detained at the I.P.K Lock-up.

2. Then Detained at the Brickfields Lock-up.

3. Then Detained at the Cheras Lock-up.

4. Finally detained at the Putrajaya Lock-up.

S 117 of the Criminal Procedure Code only allows for detention for a maximum of 14 days. How then and why was the accused detained for almost 3 months.

IF at all the deceased was detained under the Emergency Ordinance why was the family not informed/

Fifty Nine Point (59) Dissatisfaction of the family / general public against the Royal Malaysian Police force which is cruel inhumane and degrading treatment towards the deceased and his family.

1. The deceased is an innocent victim of circumstances.

2. The deceased does not have previous criminal record.

3. The deceased and / or his family does not know why he was arrested in the first place.

4. The deceased was arrested while going to a shop to by something.

5. The deceased family was not informed of his exact where about and was given a runaround by the police.

6. The deceased was never a member or part of a Secret Society.

7. Yet he was arrested and detained under Section 4 (1) Ordinan Darurat 1969.

8. IF at all there was evidence against the deceased why then was he not charged in a Court of law.

9. The deceased who is only 19 years old and without previous convictions how can he then be detained under the Emergency Ordinance.

10. The police allegations against the deceased that he is a member of a secret society, a threat to ketenteraman awam and “melalukan kesalahan-kesalahan jenayah bercorak kekerasan is unsubstainted and not proven.

11. The in ablility of the police to prove their allegations only goes to show that either the accused was innocent and / or the Police was inefficient.

12. The inefficiency of the Police force cannot be at the expense of Article 5 of the Federal Constitution which provides for the Right to life and limb.

13. IF the police had sufficient evidence against the deceased then they could and would have charged the deceased.

14. The Emergency Ordinance is an out dated legislation and not relevant in the current circumstances / times.

15. The Emergency Ordinance was abused by the Police Force.

16. The Emergency Ordinance must be used only as a last resort and in exceptional cases and only when all other avenues have been exhausted.

17. The Emergency Ordinance cannot be used at the very instance as was done for the deceased here.

18. The Emergency Ordinance is for Hard Core Criminals and not for a teenager like the deceased here.

19. Though the deceased comes from a poor family he is from a decent family and who was a brother family members and friends as University undergraduates.

20. The deceased was picked up upon and arrested and detained only because he was living in a “working class” neighbourhood.

21. Had the same deceased been living in an up market neighbourhood the may not have been arrested and let alone being detained in the first place.

22. The Police Force did not keep the family informed of the deceased exact location.

23. At the Police Force did not allow family members excess to see the deceased (except the rare occasions).

24. Even when allowed to visit, the family was not allowed to go near the deceased and ask him about his health (except the rare occasions).

25. The deceased was reported to have died of Pneumonia and / or Tuberculosis why was his family not informed of the status / condition of his health.

26. No proper and / or adequate police officers were assigned to update the deceased family on the status of the deceased detention and / or health.

27. The one and only police officer assigned one Chief Inspector Ponniah is a “political ploy” to further suppress and oppress the deceased family.

28. The police force did not inform the family on an urgent basis of the deceased’s hospitalization.

29. The deceased’s family was only informed his hospitalisation only about five days later.

30. The family had great difficulty in seeing the deceased both in the hospital and in the lock-up.

31. Only upon Special Police written permission by the police were the family allowed to see the deceased.

32. After a lot of running around repeated pleading and begging only then were the family allowed to see the deceased that too only once a week and the permission is only for day.

33. Even on the very last few hours before the deceased died and was in critical condition his mother was not allowed to go near him.

34. The Police Force even at this critical moment did not allow the mother to spend the last moments with her son.

35. Despite the mother informing the police of the deceased’s critical condition the police just told her to go home and to come back the following day.

36. The deceased until the day he died was a mere suspect and has not been proven guilty but yet he had to die at the hands of the police.

37. IF the deceased was not detained excessively under the serial arrest he would not have died.

38. Despite the Police having released the deceased on Police bail on 3.05.2002 how and why then was he detained further.

39. This is clear evidence that the accused died during the illegal custody / detention of the police.

40. When the deceased was arrested for rioting under S 48 of the Penal Code and released on Police Bail of RM2,000.00 on 3.05.2002 how then can he be detained under the Emergency Ordinance 1969.

41. This detention under the Emergency Ordinance is unlawful, void in law, abuse of police powers and done mala-fide (in bad faith).

42. No penjamin for the deceased on his released on 3.05.2002.

43. The detention of the deceased his against the pre ordinance Malaysia and Lock-up rules.

44. Even after the death the family was put through further humiliation and anxiety.

45. They were given a run around by the police and the hospital authorities even when claiming the body.

46. No mercy and / or compassion was shown by the police overall to the family of the deceased.

47. Anakguam kami mengarahkan kami bahawa anak beliau bernama THARMARAJAN A/L SUBRAMANIAM yang ditahan oleh pihak polis sejak 3.04.2002 telah dibunuh di dalam tahanan pihak polis secara perlahan-lahan dan akhirnya menghembuskan nafas terakhirnya pada 21.06.2002.

48. Ini berlaku setelah ditahan oleh pihak polis secara tidak sah disisi undang-undang dari 3.04.2002 sehingga 21.06.2002 (hampir tiga bulan) di empat balai polis yang berlainan iaitu IPK, Brickfeilds, Cheras dan akhirnya di Putra Jaya beturut-turut.

49. Semasa dalam tahanan polis Si Mati THARMA RAJAN telah memberitahu abang beliau Asokan A/L Subramaniam dan ibu beliau Selvamony A/P Adaikan bahawa beliau telah didera disiksa dan dipukul oleh pihak polis di tapak kaki, badan dan tangan beliau “who was completely at the mercy of the Police”.

50. Beliau juga telah ditampar sehingga mendapat sakit gigi. Selebihnya beliau dibiarkan tidur hanya di atas lantai semen, tidak diberikan selimut dan atau tidak dibenarkan memakai T Shirt dan di “interrogate” dalam bilik berhawa dingin yang amat sejuk walaupun beliau memberitahu pihak polis yang beliau menghadapi penyakit Asthma.

Si Mati telah selanjutnya merayu “and was pleading for mercy and he was pleading far his life” tetapi telah tidak diendahkan langsung oleh pihak polis.

51. Akhirnya Si Mati telah merayu kepada ibu, abang dan keluarga beliau supaya merayu kepada pihak polis supaya dihantar dengan segera ke hospital oleh kerana beliau mengalami kesusahan bernafas, merasa sejuk dan menggigil, badan merasa sakit, muntah, bibir merekah dan tidak dapat makan.

52. Ibu, abang dan keluarga Si Mati telah sekali lagi dan berkali-kali merayu kepada pihak polis mengenai rayuan dan aduan di atas tetapi mereka telah langsung tidak mengendahkannya dan  membiarkan Si Mati mengalami kesakitan kesengsaraan dan merangkuk didalam penjara polis / tahanan polis sehingg 
beliau meninggal dunia pada 21.06.2002.

53. Akhirnya hanya apabila mangsa menjadi kritikal, beliau telah dimasukkkan ke Hospital Putrajaya. Itupun beliau diwadkan dalam sebuah bilik tahanan yang bercermin dan keluarga tidak dibenarkan mendekati beliau. 

54. Keluarga Si Mati telah tidak diberitahu dengan segera mengenai kemasukan Si Mati ke dalam hospital dan tahap kesihatannya.

55. Ibu dan keluarga mangsa juga telah tidak dibenarkan mendekati Si Mati (kecuali sekali) dan hanya dibenarkan melihat Si Mati dari luar bilik cermin tersebut. Ibu dan keluarga juga telah tidak dibenarkan membawa Si Mati ke Pusat Perubatan Pakar yang lain walaupun permintaan dan rayuan dibuat kepada pihak polis dan / atau hospital.

56. Akhir sekali SiMati yang hanya berumur 19 tahun menghembuskan nafas terahirnya pada 21.06.2002.

58. Pihak keluarga mangsa telah juga berkali-kali merayu untuk diberikan laporan Post Mortem tetapi sehingga ke hari mereka masih belum mendapatnya.

59. Keluarga mangsa juga “was given a run around and made to wait for hours” sebelum dapat menuntut 
jenazah mangsa.

Conclusion
We hereby warn the Police Force not to abuse their powers and behave in a high handed manner. 

We hereby also challenge the Police Force to release their task force findings to us / the family within two (2) weeks from 21.06.2002 failing which they are deemed to be covering up their abuses.

We finally call upon the Police Force to have respect for human life, to abide by Article 5 of the Federal Constitution and not to abuse S 117 of the Criminal Procedure Code and the Emergency Ordinance and the Prisons Ordinans and Lock-up Rules.

In the circumstances and especially when the deceased died during the illegal custody / detention by the police and the police force not abiding by the law we call upon the Royal Malaysian Police Force to take full responsibility for the death of the deceased and to immediately suspend investigate / hold an Inquiry and take the appropriate action against the following police officers:-

Kami merujuk kepada perkara yang tersebut di atas dan melampirkan sesalinan Nota Bantahan tersebut.

Berdasarkan kepada Nota Bantahan tersebut adalah nyata yang pihak polis telah menyalahgunakan kuasa mereka dan tidak menghormati Artikel 5 Perlembagaan Persekutuan dan melampau S 117 Kanun Acara Jenayah, S 4(1) Ordinan Darurat dan Prisons Ordinance & Lock-up Rules. 

Kami memohon supaya pegawai-pegawai polis seperti berikut adalah bertanggung-jawab terhadap insan berumur 19 tahun (THARMA RAJEN A/L SUBRAMANIAM) yang tidak bersalah tersebut. Mereka seharusnya dan sewajarnya ditahan kerja sementara menunggu penyiasatan jabatan tuan:-
